Introduction

These Terms and Conditions ("Terms") govern your use of the Magnify Flow website at magnifyflow.com.au and your engagement with Magnify Flow's services. By accessing our website or engaging our services, you agree to be bound by these Terms.

Magnify Flow is operated by Clare Del Rosario (ABN: 58 296 158 080), based in Springwood, NSW, Australia ("we", "us", "our").

If you do not agree to these Terms, please do not use our website or engage our services.

1. Our Services

Magnify Flow provides the following digital marketing services to small businesses:

  • Website Design — design, build, and ongoing maintenance of websites on a monthly subscription basis

  • Google Review Management — automated review request systems, reputation management, and Google Business Profile optimisation

  • Local SEO — ongoing search engine optimisation, monthly blog content, and performance reporting

2. Engagement and Agreement

2.1 Initial consultation

Before any paid service begins, we conduct a free initial consultation to understand your business needs and confirm that our services are a good fit. No payment is required for the initial consultation.

2.2 Service commencement

Services commence when both parties have agreed to the scope of work and the first monthly payment has been successfully processed. We will confirm your service start date in writing (email is sufficient).

2.3 Provision of information

You agree to provide us with accurate, complete, and timely information required to deliver your services — including but not limited to business details, logos, photos, login credentials, and access to relevant platforms (e.g. Google Business Profile). Delays caused by late or incomplete provision of information may affect your service delivery timeline and are not the responsibility of Magnify Flow.

3. Subscription and Payment Terms

3.1 Monthly subscription model

All Magnify Flow services are provided on a month-to-month subscription basis. There are no lock-in contracts. Your subscription continues on a rolling monthly basis until either party provides notice of cancellation in accordance with clause 4.

3.2 Pricing

Current pricing for all services is published on our website. Pricing is in Australian Dollars (AUD) and inclusive of GST where applicable.

  • Website Design: $197/month

  • Google Review Management: $97/month

  • Website + Google Review Management bundle: $247/month

  • Local SEO: $397/month

  • Full package (Website + Reviews + SEO): $497/month

We reserve the right to adjust our pricing with a minimum of 30 days' written notice to active subscribers. You may cancel your subscription before the new pricing takes effect without penalty.

3.3 Billing

Subscriptions are billed monthly in advance. Your first payment is processed on or around the date your service commences. Subsequent payments are processed on the same date each month.

3.4 Payment methods

Payments are processed securely through our payment provider. We accept credit card, direct debit. We do not store your full payment card details.

3.5 Failed payments

If a scheduled payment fails, we will notify you and attempt to process the payment again within 2 business days. If payment remains outstanding after 30 days, we reserve the right to suspend your service until payment is received.

3.6 No upfront cost

Website design services are provided with no upfront design or setup fee. You pay your monthly subscription from the date your website goes live, not from the date work commences.

4. Cancellation Policy

4.1 Cancellation by you

You may cancel your subscription at any time by providing written notice to us via email at [email protected]. Cancellation takes effect at the end of the current billing period — you will not be charged for the following month. No partial refunds are provided for the current billing period.

4.1 Cancellation by us

We reserve the right to cancel or suspend your service at any time if:

  • Payment remains outstanding and unresolved after reasonable notice

  • You breach any of these Terms

  • We determine, in our reasonable judgement, that we are unable to continue providing the service to a satisfactory standard

Where we cancel your service other than for breach or non-payment, we will provide a minimum of 30 days' written notice.

4.3 Effect of cancellation

Upon cancellation of your subscription:

  • Your website will be taken offline at the end of the billing period unless alternative arrangements are agreed in writing

  • Your domain name will be transferred to you upon request — we will provide reasonable assistance with this transfer

  • Any third-party platform access credentials you have shared with us will be revoked or returned

  • We are not obligated to provide ongoing support, updates, or access to any materials created during the subscription period after the final billing date

5. Website Ownership and Intellectual Property

5.1 Domain name

Your domain name is yours. We will assist with domain registration and management as part of your service, but the domain remains your property at all times.

5.2 Website Content

Content you provide to us — including text, images, logos, and branding — remains your intellectual property at all times.

5.3 Website design and build

Websites built by Magnify Flow are created using our platform and tools. While your subscription is active, you have full use of the website. Upon cancellation, website files and design assets may not be transferable in all cases due to platform dependencies. We will always be transparent about this before your service commences and will discuss your options at the time of cancellation.

5.4 Blog and SEO content

Blog posts and SEO copy written by Magnify Flow as part of your subscription are created for your business and remain your property upon completion of the work. You are free to use this content on other platforms.

5.5 Magnify Flow materials

All materials, systems, processes, templates, and tools used by Magnify Flow to deliver services remain the intellectual property of Magnify Flow.

6. Service Delivery and Performance

6.1 Website build timeline

We aim to design, build, and launch your website within 2–3 weeks of receiving all required content and information from you. This timeline is indicative and may vary depending on the complexity of your requirements and the timeliness of your content provision.

6.2 SEO results

We do not guarantee specific search engine rankings or traffic outcomes. SEO is an ongoing process and results vary depending on factors outside our control including search engine algorithm changes, competitor activity, and the age and authority of your domain. We will always provide honest, realistic expectations at the start of your engagement.

6.3 Google Review Management

Our review management system operates in compliance with Google's review policies. We do not guarantee a specific number of reviews or a specific star rating. Results depend on the volume of jobs you complete and the responsiveness of your customers.

6.4 Unlimited updates

The Website Design subscription includes unlimited website updates at our reasonable discretion. This includes text changes, image updates, and minor structural adjustments. Large-scale redesigns, additional pages beyond your agreed scope, or requests that require substantial development work may be quoted separately.

7. Third-Party Platforms and Services

Our services rely on third-party platforms including but not limited to GoHighLevel (CRM and website platform), Google (Google Business Profile, Google Analytics), and social media platforms. We are not responsible for any changes, outages, policy updates, or discontinuation of services by these third-party providers that affect our ability to deliver your service. We will notify you promptly of any material changes that affect your service.

8. Confidentiality

Both parties agree to keep confidential any sensitive business information shared during the course of the engagement. This includes but is not limited to business performance data, login credentials, customer data, and pricing information. This obligation survives the termination of your subscription.

9. Limitation of Liability

To the maximum extent permitted by Australian law:

  • Magnify Flow's total liability to you for any claim arising out of or in connection with your subscription shall not exceed the total monthly fees paid by you in the three months preceding the claim

  • We are not liable for any indirect, consequential, or special loss or damage, including loss of revenue, loss of customers, or loss of business opportunity

  • We are not liable for any loss or damage caused by third-party platform outages, algorithm changes, or policy updates outside our control

Nothing in these Terms limits any rights you may have under the Australian Consumer Law.

10. Australian Consumer Law

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the services remedied if they fail to be of acceptable quality.

11. Disputes

If you have a complaint or dispute regarding our services, please contact us first at [email protected] and we will make every reasonable effort to resolve the matter promptly and fairly. If we are unable to resolve the dispute directly, either party may seek mediation through a recognised Australian dispute resolution service.

12. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Both parties submit to the non-exclusive jurisdiction of the courts of New South Wales.

13. Changes to These Terms

We may update these Terms from time to time. Any changes will be published on this page with an updated date. We will notify active subscribers of any material changes by email with a minimum of 14 days' notice before the changes take effect. Continued use of our services after that date constitutes acceptance of the updated Terms.
